About these terms
These terms and conditions apply to the PuppyCal app for mobile devices, together with any related services operated by Himnerom (collectively, the "Application"). Himnerom is hereby referred to as the "Service Provider".
By downloading or using the Application, you agree to these Terms and Conditions. You should read them carefully before using the Application. How personal data is handled is described in the Privacy Policy.
Not veterinary advice
PuppyCal keeps a record of what a dog eats and weighs. It does not diagnose, treat, or give veterinary advice, and it does not recommend a target weight, a diet or a brand. Decisions about your dog's weight, food and health belong with you and your vet. If you are worried about your dog, contact a vet.
- Estimates are estimates. Photo estimates are shown as ranges because they are uncertain. Check and correct them.
- Calorie figures are general. A calculated calorie target comes from published formulas and is labelled as an estimate. The Application does not calculate one for dogs that are still growing, pregnant or nursing, on a therapeutic diet, or with a condition you have flagged; for those dogs, use the figure your vet gives you.
- The target weight is yours. The Application stores the number you enter and never changes it.
- Food data may be incomplete. The food database includes figures from other users. Items from a verified source are marked. Check anything that looks wrong against the label.
License to use the Application
Subject to your compliance with these Terms, the Service Provider grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Application on a mobile device for personal purposes. You may not reproduce, distribute, modify, create derivative works from, reverse engineer, decompile, or disassemble the Application, except as and only to the extent that such activity is expressly permitted by applicable law.
Your account and household
- You must be at least 15 years old, the age of digital consent in France, or have a parent or guardian's consent, to create an account. Where your country sets a higher age, that age applies.
- Keep your sign-in secure. You are responsible for activity under your account unless it was used without your permission and you tell the Service Provider promptly.
- You can invite other people to a dog's record. Everyone with access has the same access: they can see the full history and add, edit or delete any entry. Every entry records who made it. Invite only people you trust with that record; you can remove someone at any time and they lose access immediately.
Your records and photos
What you record and the photos you take remain yours. You give the Service Provider a non-exclusive, royalty-free licence to store, copy, process and display them only as needed to operate the Application for you and the people you share a dog with, including sending photos for processing. This licence ends when you delete the content or your account, subject to the retention periods in the Privacy Policy. Your content is never published or used for advertising.
If you add a product to the food database, you allow the Service Provider to include its name and nutrition figures in the database for all users; your identity is not attached.
You agree not to:
- upload anything illegal, or content that infringes someone else's rights;
- upload photos of other people without their consent;
- submit food data you know to be false;
- try to access other people's accounts or records, or interfere with the Application or its servers.
Intellectual Property
The Service Provider retains all intellectual property rights in the Application, including its code, design, trademarks, service marks, trade names, logos, and branding. Nothing in these Terms grants you any license or right to use the Service Provider's trademarks, logos, or branding for any purpose. You agree not to remove, alter, or obscure any copyright, trademark, or other proprietary notices displayed in or on the Application. Open-source components are used under their own licences, listed in the Application's settings.
Artificial Intelligence
The Application uses AI to estimate the contents and calories of food from photos, to read nutrition labels, and, if you use it, to estimate a body condition range. These outputs can be wrong, which is why they are shown as ranges and are always editable. They are aids to record-keeping, not advice.
Price and payment
The price and what it includes are shown before you buy. Subscriptions renew automatically until cancelled in your account settings at least 24 hours before renewal. The Service Provider will not start charging for a feature you already use for free without telling you in advance.
Connectivity and device
Most of the Application works offline, and changes sync when you reconnect. Barcode lookups, label reading, photo estimates and body condition checks need an internet connection. Data charges from your mobile provider, including roaming, are your responsibility.
It is your responsibility to keep your device secure. The Service Provider advises against jailbreaking your device, which can compromise its security and stop the Application from working correctly.
Third Party Services
The Application uses the following third-party services, which have their own terms:
Updates and availability
The Service Provider releases updates to fix problems and improve the Application, and some may be needed to keep using it. The Service Provider works to keep the service available but cannot guarantee it will be uninterrupted or free of errors.
Features may change as the Application develops, but you will always be able to export your records. If the Service Provider decides to stop offering the Application, it will give at least 60 days' notice in the Application so that you can export everything.
Suspension and termination
You can stop using the Application at any time and delete your account from its settings.
The Service Provider may suspend your access if you materially breach these Terms. It will give you written notice of the breach and, where the breach can be remedied, 14 days to remedy it before terminating your access. It may suspend access immediately, without notice, only if you break the law, infringe intellectual property rights, or put other users or the service at risk. Unless the law prevents it, the Service Provider will explain the reasons for any suspension and give you the opportunity to export your records.
Limitation of Liability
The Service Provider provides the Application with reasonable care and skill. To the fullest extent permitted by law, it is not liable for indirect or unforeseeable losses, for loss of data you could have exported, or for decisions about a dog's care based on estimates or figures shown in the Application.
The Service Provider retains full liability for:
- Death or personal injury caused by negligence
- Fraud, gross negligence or wilful misconduct
- Any other liability that cannot be excluded or limited under applicable law
If you are a consumer, nothing in these Terms affects your statutory rights, including the legal guarantee of conformity for digital content and services under French and EU law.
Apple App Store
If you downloaded the Application from Apple's App Store, these additional terms apply:
- These Terms are between you and the Service Provider, not Apple. The Service Provider, not Apple, is responsible for the Application and its content.
- Your licence is limited to Apple-branded devices you own or control, as allowed by the App Store usage rules.
- Apple has no obligation to provide maintenance or support for the Application.
- If the Application fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for the Application.
- The Service Provider, not Apple, is responsible for any claims relating to the Application, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection claims.
- If a third party claims the Application infringes their intellectual property rights, the Service Provider, not Apple, is responsible for investigating, defending and settling that claim.
- You confirm that you are not located in a country subject to a US government embargo and are not on any US government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Illegal content (Digital Services Act)
Content in the Application is visible only to you and the people you share a dog with; nothing is published publicly. Under the Digital Services Act (Regulation (EU) 2022/2065), the single point of contact for users and authorities is [email protected]. Anyone can report content they believe to be illegal to that address, with enough information to identify it. The Service Provider will acknowledge the report, review it, and, if it restricts content or an account, give the person concerned a statement of the reasons and the available means of redress.
Governing Law and Disputes
These Terms are governed by French law. If you have a problem, please contact [email protected] first; most things can be settled that way.
Severability
If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions of these Terms shall remain in full force and effect.
Entire Agreement
These Terms and Conditions, together with the Privacy Policy, constitute the entire agreement between you and the Service Provider concerning your use of the Application, superseding any prior agreements or understandings.
Changes to These Terms and Conditions
The Service Provider may update these Terms when the Application or the law changes. If a change materially affects you, it will be announced in the Application at least 30 days before it takes effect; if you do not agree, you can export your records and close your account before then. Previous versions are available on request at [email protected].
These terms and conditions are effective as of 2026-09-21.
